Introduction

Welcome to Sunny Academy. These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service"), including AI Speaking Practice ("Speak with Sunny"), tests, vocabulary, grammar, and other learning tools. The Service is operated by SignedByGevorg ("SignedByGevorg", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Definitions

"User" or "you" means any person who uses the Service. "Content" means any materials available through the Service, including text, questions, answers, explanations, and other learning resources. "AI Features" means features that generate or assist in generating educational content using automated models. "User Content" means any content you submit to the Service, such as answers, feedback, messages, or suggestions.

Accounts and eligibility

You can try some features as a guest without an account. To keep your practice history and credits, create an account and keep your sign-in details secure; you are responsible for activity on your account. You must be old enough to accept these Terms where you live. If you are younger, a parent or guardian must accept them on your behalf and supervise your use. An account is for one person — do not share, sell, or transfer it.

Credits

AI features, including speaking practice, writing feedback, pronunciation scoring and AI-scored tests, may use Sunny Credits. Your applicable access and credit cost are shown before you start. Check the Pricing page for current plans and credit packs. Actions that fail for technical reasons on our side are not charged. Any available bonus credits and their expiry dates are shown with your balance. Credits you buy in a credit pack do not expire while your account is open. Credits have no cash value, cannot be transferred to another account or exchanged for money, and can only be used on Sunny Academy. If you delete your account, any remaining credits are lost.

Paid plans and payments

Sunny Plus is a subscription. Its current benefits and included credits are shown on the Pricing page and at checkout. Credit packs are one-time purchases. The current prices and credit amounts are always shown on the Pricing page and at checkout, and these govern your purchase; taxes may be added at checkout. Payments are processed by Lemon Squeezy, which acts as merchant of record: it charges you, collects applicable taxes, and issues receipts and invoices. Where cryptocurrency checkout is offered for a credit pack, that payment is processed by NOWPayments: the amount in the selected coin and network is fixed when the payment is created and must be paid before the payment expires; network fees are paid by you, and under-payments, over-payments or payments sent on the wrong network are handled case by case through support. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time and keep your plan until the end of the period you have paid for. If we change the price of Sunny Plus, the new price applies from your next billing period and we will tell you in advance. Refunds are covered by our Refund Policy and cancellations by our Cancellation Policy.

Fair use

Sunny Plus and credits are for normal personal learning. One active practice session per account at a time. Automated access, scripts, shared accounts, or reselling access are not allowed, and we may limit or suspend accounts that do this.

Use License

Sunny Academy grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, educational, and non-commercial purposes, subject to these Terms. You may not copy, reproduce, distribute, sell, sublicense, or create derivative works from the Service or Content (except your own User Content) without our prior written permission.

AI Speaking and AI feedback

AI Speaking uses your microphone recording to transcribe what you say and to give feedback on grammar, vocabulary, and pronunciation, with spoken replies. Feedback is generated automatically, is meant for practice, and may contain mistakes. It is not an official assessment, certificate, or exam result. See our Privacy Policy for how recordings are processed and how long they are kept.

Disclaimer

The Service and Content are provided on an "as is" and "as available" basis. AI feedback is educational and may contain mistakes. Sunny Academy does not provide official certification or regulated exam results. To the maximum extent permitted by law, Sunny Academy disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Some learning content may be generated by AI and may contain errors, omissions, outdated information, or biased output. You are responsible for verifying important information independently.

Limitations

To the maximum extent permitted by law, in no event shall Sunny Academy, its owners, affiliates, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or business, arising out of or related to your use of (or inability to use) the Service or Content, even if advised of the possibility of such damages.

Suspension and account deletion

You can delete your account at any time in your profile. If you have an active Sunny Plus subscription, deleting the account cancels it automatically with the payment provider; if the cancellation cannot be confirmed, the account is not deleted until the subscription is cancelled. We may suspend or close accounts that break these Terms. If we close your account without you having broken these Terms, we will refund the unused part of any prepaid plan or credits.

Changes to these Terms

We may update these Terms from time to time. When we do, we change the "Last updated" date above and, for significant changes, notify you by email or on the site before they take effect. Continuing to use the Service after that means you accept the updated Terms. Nothing in these Terms limits rights you have under mandatory consumer-protection law.
